The truth about shifts - advice from Karren Brady

I have just started a new job, when interviewed for the job I explained one of the reasons for me wanting to leave my last job was the fact that I was not seeing much of my family due to shift patterns. In the interview I asked about shift patterns and was told that there were 3 shifts but he was undecided on how he would work these they are 8-4 9-5 and 1-9. Now I have started work I have found out that some of the people work 8-4, 1-9, 9-5, 1-9. If I knew this was the case I would not have taken the job and I think my boss knows that, also he only issues a rota once a week for a week and he issues this on the Friday for the coming Monday, if you are on shift work is there a minimum length a rota should be issued for and how much notice do you need to inform your employees?

This is a bit tricky as it would depend on each company's individual policy or contract - check yours.
It would depend on your current contracted hours and how much of a change the rota will be making to your contract and terms of employment.
You should ask your employer to enter consultation with you so they can explain their business reasons for doing the rota hours and then get their agreement if possible prior to making changes. If the rota alters your contractual terms significantly and is done without your agreement - i.e. you refuse to adhere to it - it could be deemed that you have a case of constructive dismissal.
